1. Acceptance of Terms

By accessing and using Patchy's platform and services, you accept and agree to be bound by the terms and provisions of this agreement. These terms apply to all users of the platform, including customers (homeowners) and service providers (contractors, referred to as "Patchymen"). If you do not agree to abide by these terms, please do not use this service.

2. Platform Description

Patchy Home Services Inc. operates an online marketplace platform that connects homeowners ("Customers") with independent contractors ("Patchymen") for home repair, maintenance, patching, painting, and improvement services. Patchy acts as an intermediary platform facilitating these connections and does not itself perform the physical services.

Patchy is not a contractor, employer, or agent of any Patchyman. Patchymen are independent service providers who use the Patchy platform to find and complete work. Patchy does not guarantee the quality, safety, legality, or timeliness of services provided by Patchymen, except as expressly stated in our Warranty Policy for Ultra package services.

3. How the Platform Works

For Customers

Customers can create service requests ("Orders") by describing the work needed and uploading relevant photos or documents. Once an order is posted, verified Patchymen may submit bids with their proposed pricing. Customers review bids — including contractor ratings, completed work history, and pricing — and select the bid that best suits their needs. After a bid is accepted, the assigned Patchyman is responsible for completing the work as described.

For Patchymen (Contractors)

Patchymen are independent contractors who register on the platform, complete a verification and onboarding process, accept platform rules, and connect a Stripe Connect payout account to receive payments. Patchymen may browse available orders and submit bids. By using the platform, Patchymen agree to:

  • Accept and comply with the platform rules presented during onboarding
  • Maintain accurate profile information, including valid licenses where applicable
  • Complete accepted work professionally and in accordance with the order description
  • Upload work completion photos as required by the platform
  • Pay the applicable platform service fee, which is deducted from each payment received through the platform

4. Booking and Payment

Services are booked through the platform by creating an order and accepting a Patchyman's bid. Payments are processed securely through our third-party payment processor, Stripe Payments (operated by Stripe, Inc. and its Canadian affiliate). Payment is collected from the Customer only after the Patchyman has marked the work as complete.

When confirming an order, Customers may choose between two payment methods:

  • Payment Link: Patchy emails a secure Stripe-hosted checkout link; the Customer enters payment details on Stripe's checkout page and pays the final amount.
  • Saved Card: if the Customer has previously saved a card on the platform, Patchy will automatically charge that card off-session through Stripe once the work is completed. Card details are stored exclusively by Stripe; Patchy retains only a non-sensitive reference (such as card brand, last four digits, expiration date, and Stripe identifiers) to display and reuse the card.

Customers can add, replace, or delete a saved card at any time from their profile at /client/payments. Removing a saved card detaches it from Stripe and from Patchy.

Patchy operates as a marketplace facilitator. Funds are routed through Patchy's Stripe account; the applicable platform service fee is deducted, and the remaining amount is transferred to the Patchyman's connected Stripe account (Stripe Connect, Express configuration). Patchymen can view their connected account, balance, and payouts through the Stripe Express dashboard linked from their profile.

Cancellations must be made at least 24 hours in advance to avoid cancellation fees. Emergency cancellations may be subject to additional charges.

5. Communication

The platform provides an in-app messaging system that allows Customers and Patchymen to communicate about orders. All chat messages are stored on the platform. Users may also receive email notifications related to their orders, bids, and account activity. Support inquiries can be submitted through the platform's support chat feature.

Users agree not to use the communication features to share inappropriate, offensive, or illegal content, or to arrange transactions outside of the Patchy platform.

6. User Content

Users may upload content to the platform, including photos, documents, reviews, ratings, and chat messages ("User Content"). By uploading User Content, you grant Patchy a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such content in connection with operating and promoting the platform.

Reviews and Ratings: After service completion, Customers may submit reviews and ratings for the Patchyman who completed the work. Reviews are displayed publicly on the Patchyman's profile. Users agree to provide honest and accurate reviews. Patchy reserves the right to remove reviews that violate these terms or contain inappropriate content.

Work Photos: Photos of completed work uploaded by Patchymen may be displayed in the Patchyman's public portfolio on the platform.

File Uploads: Users may upload photos and PDF documents (up to 10 MB per file) when creating orders. Accepted file types include JPEG, PNG, GIF, WebP, and PDF. Users agree not to upload content that is illegal, infringing, or harmful.

7. Warranty and Liability

Patchy provides a 12-month warranty on services purchased in the Ultra package. This warranty covers defects in workmanship. The warranty does not cover normal wear and tear, damage caused by misuse, materials used, or modifications made by others. For full warranty terms, please see our Warranty Policy.

As a marketplace platform, Patchy's liability is limited. Patchy is not liable for any actions, omissions, or conduct of Patchymen or Customers. Our liability is limited to the platform service fee collected for the relevant transaction. Patchy is not liable for any indirect, incidental, or consequential damages arising from the use of the platform or services obtained through it.

8. Property Access and Safety

Customers must provide safe and reasonable access to the work area. Any hazardous conditions must be disclosed prior to service commencement. Patchymen reserve the right to refuse service if safety conditions are not met.

9. Promotional Codes

Patchy may offer promotional codes or discounts from time to time. Promotional codes are subject to specific terms and conditions at the time of issue, including but not limited to: expiration dates, minimum order amounts, usage limits per customer, and applicable service categories. Promotional codes are non-transferable, cannot be combined with other offers unless stated otherwise, and have no cash value.

10. Intellectual Property

All content on the Patchy website, including but not limited to text, graphics, logos, and images, is the property of Patchy Home Services Inc. and is protected by Canadian and international copyright laws.

11. Account and Authentication

To use certain features of the platform, you must create an account. You may sign in using an email-based one-time password (OTP) or through third-party authentication providers such as Google. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of our services, to understand our practices regarding the collection, use, and disclosure of your personal information.

13. Dispute Resolution

In the event of a dispute between a Customer and a Patchyman, the parties are encouraged to first attempt to resolve the issue directly through the platform's messaging system. If the dispute cannot be resolved directly, either party may contact Patchy support at support@patchy.ca for assistance. Patchy may, at its discretion, assist in mediating disputes but is not obligated to do so.

If a dispute cannot be resolved informally, it shall be governed by the laws of Canada and the province in which the services were provided, and resolved in the appropriate courts of that jurisdiction.

14. Modifications to Terms

Patchy reserves the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our platform constitutes acceptance of any changes. We encourage users to review these terms periodically.

15. Governing Law

These terms are governed by the laws of Canada and the province in which the services are provided. Any disputes shall be resolved in the appropriate courts of that jurisdiction. The terms are not specific to any single service location.
